As per your signed acceptance, please send this Agreement along with your photos, memorabilia and your deposit in the amount of $ ___________. REGARDING PHOTOGRAPH/MEMORABILLA HANDLING & DESIGNING PROCESS 1. _______ All items to be included in the album are to be mounted in an archival-quality album using only photo-safe adhesives, papers, accents, pens, etc. I understand that only those products labeled by reputable companies as “archival-quality”, “photo-safe”, “acid-free” and/or “lignin free” will be used, and thus any resulting damage from defective products are not liability of Colleen’s Memory Albums ( Colleen Shiach ). 2. _______ Unless otherwise specified, photos and memorabilia will be mounted in the album using “photo-safe” and/or “acid-free” adhesives that are essentially considered permanent. While it may be possible to remove photos, it is not recommended, as damage to the photos will likely occur. I will also keep this in mind if adjustments are requested after the creative process begins. 3. _______ Unless otherwise specified, photos and memorabilia may be cut (“cropped”) or altered during the creative process. Sometimes during the creative process it is more pleasing for the final layout if unnecessary backgrounds or objects are eliminated from photos in order to draw the focus to the subject of the photograph. Polaroid photos and/or portraits will not be cropped. 4. _______ Colleen’s Memory Albums ( Colleen Shiach ) is only responsible for the photos and memorabilia listed on the Inventory Sheet, which is the 4th page of this Agreement. In the event that photos and/or memorabilia provided is damaged by fire, flood, earthquake, hurricane, tornado or other unavoidable disaster (including, but not limited to, theft or auto accident) while in our possession, Colleen’s Memory Albums ( Colleen Shiach ) is only liable for the cost of reprinted photos, if negatives and/or scanned photos are available. I understand that photos or memorabilia that are irreplaceable (I.e. no negatives exist or there are no other copies) will not be Colleen’s Memory Albums ( Colleen Shiach ) liability or responsibility in any way, nor will I take any recourse. CD archive $20 Yes _______ No _______ REGARDING PROJECT COSTS 5. _______ Colleen’s Memory Albums ( Colleen Shiach ) requires a non refundable deposit of 50% of the project cost at the time this Agreement is signed. For this specific project the deposit is $ _______. This deposit will be applied towards the specific project. I understand that this project is estimated to cost $ _______. I understand that the estimated cost may include, but not limited to physical album purchase, shipping, and sales tax. I understand that Colleen’s Memory Albums (Colleen Shiach) will obtain my permission if it becomes necessary for the project cost to exceed the agreed upon amount stated above before any additional work is performed to result in additional charges. In this case, there will be an Addendum to this agreement, and the Addendum will need to be signed before any additional work is done to the project. 6. _______ When the project is completed, I understand that I will be notified and the remaining cost of the project will be due at the time the completed album is picked up or before shipped. For this specific project the remaining balance is $ _______. If the delivery method specified in the Agreement is not in person, the balance will be due prior to shipping. Any unused photos or memorabilia will be returned with the completed album. 7. _______If the delivery method in the Agreement is “shipped”, Colleen’s Memory Albums (Colleen Shiach) will send the album through a reputable mailing service (i.e. Canada Post, Federal Express or Loomis). Colleen’s Memory Albums (Colleen Shiach) will contact you with a tracking/confirmation number. I understand that shipping and handling fees will be added to the total cost. Colleen’s Memory Albums (Colleen Shiach) will send the album registered and insured for the cost of the project, with proof of delivery required. I understand that Colleen’s Memory Albums (Colleen Shiach) is only responsible for obtaining and paying for shipping insurance, and that the shipping company/agent will be liable in the event that an album is lost or damaged during shipment. I understand that in the event of a damaged or lost items, I must deal directly with the company/agent of the company that the items are shipped through. I will not hold Colleen’s Memory Albums (Colleen Shiach) liable, nor take any recourse in the event of lost and/or damaged items and/or album. 8. _______ I understand the Colleen’s Memory Albums (Colleen Shiach) accepts payment in the forms of PayPal, or money order. Colleen’s Memory Albums does accept credit card payments thru PayPal. REGARDING PROJECT COMPLETION AND SATISFACTION 9. _______ Acceptance of the completed album is construed as acceptance of and satisfaction with all work completed. In the event an album is shipped to me and I am not satisfied, I understand that I may return the album within 7 days of the initial confirmation of receipt so that Colleen’s Memory Albums (Colleen Shiach) may make my specified adjustments (adjustments are only allowed once, without additional fees). I understand that in order to make adjustments, scanned photos might need to be used in place of originals due to the permanent adhesives used in original layout during the creative process. In the event of additional adjustments, there will be additional fees charged. I understand that I am solely responsible for insuring, returning, and obtaining a tracking number on the project shipped back to Colleen’s Memory Albums ( Colleen Shiach ) for adjustments. Upon completion of the adjustments, Colleen’s Memory Albums ( Colleen Shiach )will resend the completed album registered and insured for the cost of the project, with proof of delivery required with a tracking number, at Colleen’s Memory Albums ( Colleen Shiach ) expense. ( I can not return any items and/or project for a refund). 10. _______ Every effort will be made by Colleen’s Memory Albums ( Colleen Shiach ) to complete this specific project on time. If the album is not finished by the date specified in this Agreement and the reason for the delay is solely the fault of Colleen’s Memory Albums ( Colleen Shiach ), a discount of 20 % from the final balance due of this project will be given. Colleen’s Memory Albums ( Colleen Shiach ) may need to contact you during the design process and the 20 % discount is void if the delay is because of client not returning phone calls, email or any other type of communication and/or lack or delayed payment due to Colleen’s Memory Albums ( Colleen Shiach ). 11. _______ I understand that I may reproduce copies of project/page layouts for my own personal use. I may not sell, publish, advertise, reproduce for commercial or financial gain, nor can I represent the project, designs, or page layouts as my own creation. All designs and creations by Colleen’s Memory Albums ( Colleen Shiach ) are 2004 © Copyright owned exclusively by Colleen’s Memory Albums ( Colleen Shiach). Colleen’s Memory Albums ( Colleen Shiach ) will be digitally scanning and/or taking digital pictures of the album project for her own records. Please initial ( and sign where needed ) either (A) or (B) : A. _______ I authorized Colleen’s Memory Albums ( Colleen Shiach ) to use digital images, copies or graphical representations of the album project, which includes your photographs on the page layouts for the purpose of advertisement, internet website, publicity or promotion of Colleen’s Memory Albums ( Colleen Shiach ) Your photographs will not be used, sold or lent for any other purpose than the above mentioned advertising and promotion. The photographs must and will be only shown as part of a scrapbook layout design. I understand that I forfeit any and all legal recourse and forfeit any and all financial remuneration (income, payment, or royalties). The images/layouts may be used multiple times and I only need to initial and sign this single release and authorization of use.
